Prohibition of Sexual Harassment under Title IX Policy

Lakeshore College is committed to providing an academic and work environment free of unlawful sex discrimination, including sex-based harassment, and unlawful harassment under Title IX.  To ensure compliance with applicable federal and state laws and regulations, without limitation, Title IX of the Education Amendments Act of 1972 and its implementing regulations (“Title IX”), and to affirm its commitment to promoting the goals of fairness and equity in all aspects of the educational enterprise, Lakeshore College has developed and enacted this policy to make clear that discrimination on the basis of sex, sexual harassment and retaliatory conduct related to sex-base harassment, alleged or proven, will not be tolerated.

This policy protects students, employees, applicants for admission or employment, and other individuals participating or attempting to participate in Lakeshore College’s education program or activity. 

Lakeshore seeks to foster an environment in which all employees, students, applicants for employment, and applicants for admission feel free to report incidents of sexual harassment in violation of this policy and Title IX, without fear of retaliation or reprisal. Sex discrimination, including sex-based harassment, is prohibited in all Lakeshore programs and activities or as otherwise prohibited by this policy. Forms of sex discrimination include sex stereotypes, pregnancy or related condition, sexual orientation, and gender identity. Forms of sex-based harassment include Quid Pro Quo, Hostile Environment Harassment, Sexual Assault, Dating Violence, Domestic Violence or Stalking and Sexual Exploitation. Individuals who engage in such acts have violated this policy and are subject to disciplinary action. Therefore, the college also strictly prohibits retaliation against any individual for filing a complaint of sexual harassment in violation of this policy and Title IX or for participating, or refusing to participate, in a sexual harassment investigation. The college will investigate all allegations of Title IX retaliation swiftly and thoroughly. If the college determines someone has retaliated, it will take all reasonable steps within its power to stop such conduct. Individuals who engage in Title IX retaliatory conduct are subject to disciplinary action, up to and including termination or expulsion.

Individuals who are subject to acts of sex discrimination or sex-based harassment are encouraged to report these incidents. The college will investigate all allegations of Title IX retaliation swiftly and thoroughly as all complaints are treated seriously and investigated fully and impartially. Lakeshore will provide access to appropriate resources to any individual who experiences sex-based harassment, regardless of whether the individual decides to file a formal complaint under this policy.

This policy applies to all aspects of the academic environment, including but not limited to classroom conditions, grades, academic standing, employment opportunities, scholarships, recommendations, disciplinary actions, and participation in any community college activity. In addition, this policy applies to all terms and conditions of employment, including but not limited to hiring, placement, promotion, disciplinary action, layoff, recall, transfer, leave of absence, training opportunities, and compensation.

To this end the College President shall ensure the institution undertakes education and training activities to counter sexual harassment and to prevent, minimize, or eliminate any hostile environment that impairs access to equal education opportunity or impacts the terms and conditions of employment.

The College President shall establish procedures that define sexual harassment on campus. The College President shall further establish procedures for employees, students, and other members of the campus community that provide for the investigation and resolution of complaints regarding sexual harassment in violation of this policy, and procedures to resolve complaints of sexual harassment in violation of this policy. State and federal law and this policy prohibit retaliatory acts against all participants by the college, its employees, students, and agents.

Lakeshore will publish and publicize this policy and related written procedures (including the procedure for making complaints) to administrators, faculty, staff, students, applicants for employment, and applicants for admission, particularly when they are new to the institution. The college will make this policy and related written procedures (including the procedures for making complaints) available in all administrative offices and will post them on the college’s website.

Employees who violate the policy and procedures may be subject to disciplinary action up to and including termination. Students who violate this policy and related procedures may be subject to disciplinary measures up to and including expulsion. Volunteers or unpaid interns who violate this policy and related procedures may be subject to disciplinary measure up to and including termination from the volunteer assignment, internship, or other unpaid work experience program.

Members of the Lakeshore community are encouraged to direct Title IX questions, concerns, and complaints to the Title IX Coordinator or the Title IX Deputy Coordinators. If the Title IX Coordinator or a Deputy Coordinator is alleged to be the person who engaged in discrimination or sexual misconduct, the report may be filed with another of the named offices or with the office of the Vice President of Student Success.

How to File a Title IX Complaint - Students

Any student who believes he, she or another student has been the victim of any form of sexual misconduct is encouraged to file a complaint identifying the alleged individual and describing the conduct, incident(s) or occurrence(s) that form the basis for the complaint. Students may file complaints with any Lakeshore College employee, who will then notify the Title IX Coordinator/Title IX Student Deputy Coordinator. If the Title IX Coordinator or Title IX Student Deputy Coordinator is alleged to be the person who engaged in discrimination or sexual misconduct, the incident will be investigated by the Title IX Employee Deputy Coordinator.

Any Lakeshore staff member can help with filling out the incident report. To file a complaint, complete the Sexual Harassment Incident Report. If, due to a disability, accommodations are needed to assist the student with filing a complaint, please contact: Accommodation Services at (920) 693-1120. The complainant is encouraged to file the complaint as soon as possible after the incident to ensure a prompt and equitable process for all the parties involved in the situation. 

Written complaints may be submitted to the Title IX Coordinator or Title IX Deputy Coordinator.

How to File a Title IX Complaint - Staff

Any employee who believes he, she or another has been subject to or witnessed sexual misconduct (harassment) is encouraged to promptly come forward to file a complaint with the College. If the complaint is made in writing, the complainant alleging the sexual misconduct, will be asked to sign the statement. If the complaint is made verbally, then the complainant will be requested to sign a written report acknowledging the content of the statement. All reports must include details regarding the incident or conduct giving rise to the complaint, location and dates of the incident, any witnesses to the alleged incident and any action requested to resolve said incident. If the Title IX Employee Deputy Coordinator is alleged to be the person who engaged in discrimination or sexual misconduct, the incident will be investigated by the Title IX Coordinator.

Verbal or written complaints may be submitted to the Title IX Coordinator or the Title IX Deputy Coordinator.
